What is a Building Permit and what are its types?
A Building Permit is a permit or authorization granted by the City Council that allows construction, renovation or modification work to be carried out on a building or property.
There are only two types of Working Permit: major and minor. The main difference is that a Minor Permit does not affect the structure, even if the work is complex. However, a Major Permit involves direct impact on the structure. However, regardless of the scale of the work, it is advisable to consult with the City Council and inform them about the type of intervention to be carried out.
In Torrevieja, a Major Works Permit is required when modifications affect the structure or supporting elements of the property, such as the roof, façade, foundations, or when the living space needs to be expanded. It also applies when a change of use is made to the building, for example, changing its use from private housing to commercial premises.
The process for obtaining this license is more complex, as it requires the participation of an architect or technical architect. Torrevieja City Council requests more complete documentation, including plans and an architectural report, as well as information on the purpose of the works and the reason for their execution. In these situations, the renovation cannot begin until the city council grants its approval.
In the case of a Minor Works License, the steps to follow would be to present the required documentation to the Torrevieja City Council and pay the established fee. Once the Administration's permission is obtained, the renovation process can begin. If the City Council detects any irregularities in the work, they must be corrected.
In certain cases, depending on the type of work, the reform process can be started without receiving a response from the city council, which is what is known as «immediate statement or responsible declaration». However, this changes to “deferred communication” when prior approval from the city council is required. These situations occur when the actions are related to works in protected buildings or are minor works that do affect the internal structure of the building.
What are the requirements for applying for a building permit in Torrevieja?
Each municipality has its own specific procedure for regulating the execution of works, but in general, works affecting urban buildings must include certain documentation that must be submitted to the City Council or Urban Planning Department. The requirements are detailed below:
Minor works:
1. Copy of the minor works authorization, responsible declaration or prior communication.
2. Responsible declaration with the start date of the construction, installation or work.
3. Budget for the work.
Major works:
1. Building Permit or urban planning permit.
2. Financial summary of the project with the collegiate endorsement, if required.
3. Document justifying the start of the work.
Each municipality has its own payment procedures, but generally the license and additional documentation are paid automatically through a payment document that must be made at the banking institutions that collaborate with the Torrevieja City Council.
How to apply for a building permit in Torrevieja?
If you are considering remodeling your home, regardless of the size of the project, you will need to apply for a building permit, which may be more or less extensive. The technical term for these procedures is a Responsible Declaration for a Building Permit.
This procedure can be carried out both online and in person, but it always requires registration. All building permits in Torrevieja must be submitted through an application in accordance with the established model, which must be signed by the developer and the contractor of the work, and must include all the necessary technical details: budget, location of the work, intended use or purpose and description of the renovation.
Additionally, the property's cadastral identification, the Real Estate Tax (IBI) receipt and the receipt showing payment of the Municipal Tax on Construction, Installations and Works (ICIO) must be included as proof of having complied with the applicable rates.

The Torrevieja City Council is responsible for establishing the rates and specific regulations for the payment of the ICIO. In some municipalities, the application may be free due to the absence of urban planning fees. Any work requiring a license must include payment, which generally varies between 3% and 5%.
